In South Carolina, modified comparative negligence allows you to seek recovery for damages (injuries or losses caused due to the other party’s carelessness) in a car accident claim as long as your fault is 50% or less. However, your potential awarded compensation would be reduced by the percentage of fault attributed to you. A plaintiff deemed 51% responsible or higher would not be eligible for compensation.
