If you were recently in a construction accident in Seneca, South Carolina, you may be eligible to file for compensation. You may be able to hold your employer or the at-fault party liable for your injuries. This depends on whether you were injured in a work-related accident or while passing through or near a construction site as a non-employee.

At Hammack Law Firm, we handle both personal injury and workers’ compensation cases. We offer free case reviews in which we can discuss your litigation options and next steps. A lawyer from our team can guide you throughout your journey toward financial recovery.

Both Construction Workers and Non-Employees may be Able to Recover Damages After a Construction Site Accident

If you were injured on a construction site or because of construction-related factors but are not the construction company’s employee, you may be able to pursue compensation through a personal injury lawsuit.

Per S.C. Ann. §15-32-210, you may demand compensation for the following types of damages:

  • Medical care expenses, including future bills you may have to pay to treat your injuries
  • Costs for rehabilitation
  • Property damage
  • Reduced earning capacity
  • Current and future loss of income and benefits
  • Costs for domestic services if your injuries limit you from performing them yourself, such as childcare or home care
  • Loss of business or employment opportunities
  • Pain and suffering
  • Physical disfigurement or permanent disability
  • Mental anguish or emotional distress
  • Psychological trauma

This statute covers a variety of damages, so you may be entitled to other compensable damages not listed here. Our lawyers can review the case and help you calculate how much compensation to pursue based on what you have experienced or may expect to experience.

Workers’ Compensation Available for Construction Employees

If your construction accident in Seneca occurred while you were working, a lawyer from Hammack Law Firm can help you file for workers’ compensation. Unlike personal injury cases, workers’ compensation benefits only cover certain damages.

According to the Social Security Administration (SSA), workers’ compensation benefits in South Carolina include:

  • Two-thirds of your weekly wages up to 340 or 500 weeks, depending on your type of disability
  • Medical expenses, provided you see a medical provider supplied by your employer
  • Disfigurement benefits up to 50 weeks

Workers’ compensation does not compensate for pain and suffering, other living cost adjustments, or retirement.

Our Attorneys will Use All of the Resources Available to Us to Help You Build Your Case

Construction accident cases can easily get complicated for many reasons. Multiple liable parties may be involved, you may not have all the evidence available to build a case, or you may be unsure about your rights.

Our legal team can guide you through the legal process of building a construction accident case once you become our client. If you are building a personal injury or wrongful death case, we can offer to:

  • Identify all of the liable parties in the case
  • Retrieve evidence on your behalf, such as the accident report, witness testimony, and video footage
  • Put together the legal paperwork for the case
  • Represent you during negotiation meetings or a case trial
  • Provide legal advice when you are facing legal decisions, such as accepting or rejecting a settlement offer

If you are filing a workers’ compensation claim, we can help prepare the claim so that it is accurate and complete. We also can help you appeal the claim if it got denied by gathering additional evidence and appearing as your representative during hearings.

You Need to Keep Track of the Filing Deadlines that Apply to Your Claim

Whether you are filing a workers’ compensation claim, a personal injury lawsuit, or a wrongful lawsuit, you must abide by the case’s legal filing deadline:

  • You generally have 90 days to report an injury to your employer if you intend to file a workers’ compensation claim, according to the South Carolina Workers’ Compensation Commission (WCC).
  • You have up to two years from the date of injury to file for workers’ compensation in South Carolina. Surviving dependents have up to two years from their loved one’s death to claim benefits as well.
  • S.C. Ann. §15-3-530 gives a three-year filing period for both personal injury and wrongful death lawsuits. Starting points begin on the date of the accident or death, respectively.
  • The South Carolina Bar (SCB) states that you have 14 days to appeal a workers’ compensation claim denial.

If you fail to meet any of the appropriate deadlines for the case, you could lose the opportunity to pursue compensation. Part of our legal services involves monitoring these deadlines so we can alert you when we must file the case.
