The Date You Became Aware of Your Injuries Determines the
Legal Filing Deadline

In South Carolina, the deadline for filing a medical malpractice lawsuit varies depending on when you became aware of your injuries. In some cases, patients may know right away about their injuries. In this case, you have about three years from the date of the incident to file a lawsuit, per S.C. Ann. §15-3-545.

However, if you discovered the injuries later, you have about three years from the date of discovery to file a lawsuit as long as this discovery is within six years of the initial occurrence.

You Must File a Notice of Intent Before Filing a Lawsuit

Per S.C. Ann. §15-79-125, you must file a notice of intent with the parties you intend to sue. This notice must include a statement about the injuries you suffered and the facts of the case that led you to take action. This notice tolls the statute of limitations applicable to the case.
