What If My Friend Wrecked My Car?
April 22, 2024 – Paul Hammack
If a friend is in an accident and wrecks your car, your liability insurance should cover the costs of injuries to others involved in the accident as part of your bodily injury protection. The property damage portion of your insurance coverage will also compensate the other driver for damage to the car. If you have collision insurance, your own insurer will also repair or replace your car.
It can be confusing and hard to know what to do if your friend wrecked your car. When our personal injury team represents you, we help you understand the ins and outs of auto insurance and how it applies to your property damage case. We also help you deal with your insurance company or your friend’s insurer to ensure your car is restored to its pre-accident condition.
Understand How Your Insurance Can Help
According to South Carolina Department of Insurance (SC DOI) guidelines, all vehicle owners are required to carry liability and uninsured motorist (UM) coverage. Your insurer is also obligated to offer underinsured (UIM) motorist coverage although, you are not required to accept it. These forms of insurance can help resolve your car accident and property damage.
Damage Covered By Liability Insurance
If the driver or occupants of another car or pedestrians were injured in a collision when a friend was driving your car, your liability policy will pay up to $25,000 per person and up to $50,000 per accident for bodily injuries if your friend was at fault for the accident. It will also pay up to $25,000 per accident for property damage. These numbers represent the minimum required coverage.
Damage Covered By Uninsured Motorist Protection
UM coverage is automatically included in your policy and will pay for the damage to your car if your friend caused the accident but was not insured. If another driver caused the accident when your friend was driving, UM coverage will pay for the damage to your car if that driver was not insured.
Damage Covered By Underinsured Motorist Protection
If you have it, UIM coverage will step in if the friend who was driving your car is insured, but the damage exceeds the maximum payouts of his policy.
Damage Covered By Collision Protection
Collision insurance will pay for the damage to your car. It will also cover you if your car is deemed a total loss. The costs of repairs will vary depending on the damage to your car. If it declared a total loss, authoritative guides would help determine its replacement value, according to Insurance Information Institute (III) guidelines.
