Who Can Be Held Liable for Sexual Abuse in Greenville, South Carolina?

Sadly, many groups, organizations, employers, and businesses fail to protect children and adults from known abusers, or to put policies and procedures in place that will prevent sexual abuse.

Under South Carolina law, these entities may also be held accountable for the sexual abuse. This may include the employers and other employees, organizations, and businesses that covered up sexual abuse and/or allowed these acts to continue.

The Hammack Law Firm will fight to hold every single person who was complicit in a sexual abuse case accountable.

Are Sex Offenders Required to Be Registered in South Carolina?

Under Section 23-3-460, convicted sex offenders must register with the sheriff twice a year in each county where he or she lives, owns property, is employed, or attends school.

The federal government has a “tiered” sex offender registry system that allows a person to petition to be removed from the registry after a certain number of years. However, SC Code Section 23-3-460(A) mandates a lifetime registry for SC residents who are convicted sex offenders, regardless of the severity of their offense or their likelihood to re-offend.

Is There a Time Limit for a Sexual Abuse Claim in South Carolina?

The Statute of Limitations for adult sexual abuse survivors to file a personal injury claim against their abuser is within three years of the date the abuse occurred.

Previously, minors who survived such abuse could file federal claims until the age of 28 or a decade after the abuse was discovered. However, this has recently changed, and there is now no time limit for people who were sexually abused as minors to file civil claims.

How Does the “Eliminating Limits to Justice for Child Sex Abuse Victims Act” Affect My Sexual Abuse Case?

President Biden signed a bill that eliminates the statute of limitations (or time limit) for people who were sexually abused as minors to file civil claims.

The Eliminating Limits to Justice for Child Sex Abuse Victims Act was passed by a voice vote in September 2022 after passing the Senate unanimously in March.

The bill eliminates previous time limit for survivors to file civil claims related to sex abuse crimes against minors.

What Can I Do If I Was Sexually Abused as a Child in South Carolina?
