Who can file a wrongful death claim in South Carolina?

In South Carolina, the executor or administrator of the deceased person’s estate is typically the one who files a wrongful death claim. If there is no executor or administrator, the claim may be filed by the deceased person’s spouse, child, parent, or heir, in that order of priority according to South Carolina’s wrongful death statute.
