A Personal Injury Lawyer’s Perspective:
Our thoughts and prayers go out to the victim’s loved ones as they grieve this tragic loss. This is yet another sobering reminder to always stay alert to your surroundings when you are behind the wheel.
As an investigation is still in process, the degree of fault of the minivan driver still needs to be determined. If the driver is found at fault, then the surviving family may have a wrongful death claim. If the victim was the breadwinner in this family, damages for loss of support and future earnings can be recovered.
