Wrongful Death Lawsuits in South Carolina
South Carolina’s cause of action for wrongful death is found in S.C. Code Ann. § 15-51-10. This statute allows the family of a person wrongfully killed by another to bring a wrongful death claim when a person’s death was “caused by the wrongful act, neglect or default of another,” and the deceased person would have been entitled to recover damages from the wrongdoer had they survived. Nearly any fatal accident can give rise to a South Carolina wrongful death lawsuit, including:
-Bus, Train, or Airplane Accidents
-Dog or Other Animal Attacks
-Medical Malpractice or Negligence
-Nursing Home Abuse or Neglect
South Carolina’s wrongful death statute permits a decedent’s spouse or children to pursue a claim. If the decedent had no spouse or children, the action may be brought by the decedent’s parents. If there was no spouse, children, or parents, then the action may be brought by any relative or person appointed as Personal Representative (executive or administrator) for the benefit of the heirs of the estate.
In most cases, the case must be brought within three years of the accident or event that caused the death, but in some cases against government agencies or other individuals, the statute of limitations can be reduced to two years. For work-related injuries, it is important to make a claim as soon as possible to ensure that it is not barred.
What Damages Are Available in a SC Wrongful Death Lawsuit?
Damages awarded in a successful wrongful death claim may include compensation for the following:
– Funeral and burial expenses
– Medical expenses related to the deceased person’s final illness or injury
– Lost wages and job benefits
– Property damage and other financial losses related to the death
– Loss of the deceased person’s experience, knowledge, and judgment
– Loss of the deceased person’s care, companionship, and protection
– Pain, suffering, and mental anguish suffered by the surviving family members
If the conduct that caused the death was grossly negligent, reckless, or intentional, the court may also award punitive damages. Unlike other types of damages, exemplary damages are not awarded to compensate the family or estate for losses resulting from the untimely death. Instead, exemplary damages are intended to punish wrongdoers and serve as a deterrent for others who might engage in similar conduct. There are some differences between the types of damages that are available under a South Carolina wrongful death action as compared to a personal injury lawsuit when the victim was not killed.
